Terms & Conditions

1. Parties

These Terms govern your engagement with NDIS Website Designs (a trading name of AR Digital Solutions, ABN 32 686 188 661, "we", "us", "our"). By engaging our services you agree to these Terms.

2. Services

We provide website design, development, SEO, Google Ads management, social media marketing, content writing, logo design, and related digital marketing services to NDIS providers across Australia. Specific service scope is defined in individual service agreements.

3. Quotes and payment

Fixed-scope project quotes are valid for 30 days. Payment terms:

• Website builds: 40% deposit on signing, 30% at design approval, 30% at launch
• Monthly services (SEO, Ads, Social): monthly in advance, 30 days' notice to cancel
• Consulting: 50% deposit, balance on delivery

Late payments incur 1.5% monthly interest. Work may be paused if payments are overdue more than 14 days.

4. Intellectual property

On full payment, full IP rights transfer to you for all deliverables (website code, content, logo, designs). You may modify freely. We retain the right to reference completed work in our portfolio and case studies (with reasonable discretion on confidential details).

5. Revisions

Each deliverable includes two rounds of revisions at no cost. Additional revisions billed at $120/hour. Scope additions require written change orders before work commences.

6. Client responsibilities

You agree to: provide accurate information and content in a timely manner; respond to feedback requests within 5 business days (to avoid delays); ensure all content provided is legally yours to use; and use services in accordance with Australian law and NDIS Code of Conduct.

7. Warranties and liability

We warrant services will be delivered with reasonable skill and care. We do not guarantee specific SEO rankings, ad performance, or business outcomes — these depend on many factors beyond our control. Our liability is capped at the fees paid for the specific service in question, except where law provides otherwise.

8. Cancellation

Fixed-scope projects: may be cancelled with 7 days' notice. You pay for work completed to date plus a 20% cancellation fee on remaining project value. Monthly services: 30 days' written notice, no cancellation fees.

9. Confidentiality

Both parties agree to keep confidential information shared during the engagement private. This obligation continues for 3 years after engagement ends.

10. Governing law

These Terms are governed by the laws of Queensland, Australia. Disputes will be resolved through good-faith negotiation, then mediation, then Queensland courts if unresolved.
